<p>Distressed Property owners - <a href="http://www.edhomeseller.com/" target="_blank">You are not alone!</a>&nbsp; Before you walk away, educate yourself.&nbsp; They are many options available to distressed property owners at present.</p>
<p>The current U.S. housing market and national financial crisis has caused untold stress and heartache for many American families. Foreclosure is one of the most devastating financial challenges that a family can face and one that many times can be avoided. The options available to Wilmington-area residents for foreclosure are many. Following is a brief explanation of these solutions, including their benefits and drawbacks:</p>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Reinstatement</a></strong> <br />A reinstatement is the simplest solution for a foreclosure, however it is often the most difficult. The homeowner simply requests the total amount owed to the mortgage company to date and pays it. This solution does not require the lender's approval and will 'reinstate' a mortgage up to the day before the final foreclosure sale.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Does not require the mortgage company or lender's approval. </li>
<li><span style="text-decoration: underline;">Drawback</span>: Requires that a homeowner be able to pay all back payments, fines and fees. </li>
</ul>
<p><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank"><strong>Forbearance or Repayment Plan</strong><br /></a>A forbearance or repayment plan involves the homeowner negotiating with the mortgage company to allow them to repay back payments over a period of time. The homeowner typically makes their current mortgage payment in addition to a portion of the back payments they owe.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Allows the homeowner to make back payments over time. </li>
<li><span style="text-decoration: underline;">Drawback</span>: Requires that a homeowner be in a financial position to pay not only their current mortgage, but also a portion of the back payments owed. Some mortgage companies will require a homeowner to 'qualify' for forbearance. </li>
</ul>
<p><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank"><strong>Mortgage Modification</strong><br /></a>A mortgage modification involves the reduction of one of the following: the interest rate on the loan, the principal balance of the loan, the term of the loan, or any combination of these. These typically result in a lower payment to the homeowner and a more affordable mortgage.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Reduces the payment a homeowner is required to make on a monthly basis and may reduce the principal balance of the loan </li>
<li><span style="text-decoration: underline;">Drawback</span>: Requires that a homeowner 'qualify' for the new payment and will often require full documentation. Lender has to be actively pursuing modifications. </li>
</ul>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Rent the Property</a></strong> <br />A homeowner who has a mortgage payment low enough that market rent will allow it to be paid, is able to convert their property to a rental and use the rental income to pay the mortgage.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Allows homeowner to keep property indefinitely. </li>
<li><span style="text-decoration: underline;">Drawback</span>: The issues that can arise with a rental property are many, and rent often does not cover the full cost of property ownership and maintenance. </li>
</ul>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Deed in Lieu of Foreclosure</a></strong><br />Also known as a 'friendly foreclosure', a deed in lieu allows the homeowner to return the property to the lender rather than go through the foreclosure process. Lender approval is required for this option, and the homeowner must also vacate the property.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Many times in a successful deed in lieu, the lender will forego their right to a deficiency judgment. </li>
<li><span style="text-decoration: underline;">Drawback</span>: Requires that a homeowner vacate the property, and a deed in lieu may be reported to credit bureaus as a foreclosure. </li>
</ul>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Bankruptcy</a></strong> <br />Many have considered and marketed bankruptcy as a 'foreclosure solution,' but this is only true in some states and situations. If the homeowner has non-mortgage debts that cause a shortfall of paying their mortgage payments and a personal bankruptcy will eliminate these debts, this may be a viable solution.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Does not require lender approval. </li>
<li><span style="text-decoration: underline;">Drawback</span>: If a homeowner cannot afford their mortgage payment, a bankruptcy will only stall-not stop-the foreclosure process. Bankruptcy can be costly, is damaging to credit scores, and can only be declared once every seven years. </li>
</ul>
<p><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank"><strong>Refinance</strong> <br /></a>If a homeowner has sufficient equity in their property and their credit is still in good standing, they may be able to refinance their mortgage.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: In some cases, this will lower payments. </li>
<li><span style="text-decoration: underline;">Drawback</span>: In today's market, a refinance will almost always raise mortgage payments, and is an expensive process. </li>
</ul>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Servicemembers Civil Relief Act (military personnel only)</a></strong> <br />If a member of the military is experiencing financial distress due to deployment, and that person can show that their debt was entered into prior to deployment, they may qualify for relief under the Servicemembers Civil Relief Act. The American Bar Association has a network of attorneys that will work with servicemembers in relation to qualifying for this relief.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: If qualified, this will lower payments on all consumer debt in addition to mortgage payments. </li>
<li><span style="text-decoration: underline;">Drawback</span>: Must be active military to qualify. </li>
</ul>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Sell the Property</a></strong> <br />Homeowners with sufficient equity can list their property with a qualified agent that understands the foreclosure process in their area.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: Allows homeowner to avoid foreclosure and harvest some of their equity. </li>
<li><span style="text-decoration: underline;">Drawback</span>: In many cases today, homeowners do not have sufficient equity to sell their property without negotiating a short sale (see next solution). </li>
</ul>
<p><strong><a href="http://www.wilmingtonnc-shortsales.com/" target="_blank">Short Sale</a></strong><br />If a homeowner owes more on their property than it is currently worth, then they can hire a qualified real estate agent to market and sell their property through the negotiation of a short sale with their lender. This typically requires the property to be on the market and the homeowner must have a financial hardship to qualify. Hardship can be simply defined as a material change in the financial stability of the homeowner between the date of the home purchase and the date of the short sale negotiation. Acceptable hardships include but are not limited to: mortgage payment increase, job loss, divorce, excessive debt, forced or unplanned relocation, and more.</p>
<ul>
<li><span style="text-decoration: underline;">Benefit</span>: A short sale allows the homeowner to avoid foreclosure and salvage some of their credit rating. This also keeps foreclosure off the individual's public record, and in many cases will allow the homeowner to avoid a deficiency judgment. Borrower may qualify for another mortgage in as little as 24 months (as opposed to five years for a foreclosure). </li>
<li><span style="text-decoration: underline;">Drawback</span>: Short sales can be a trying process in which a homeowner is best served by contracting with a qualified real estate agent to guide the way. </li>
</ul>

<p>An e-mail gets sent asking for feeback, and....nothing!&nbsp; A phone call gets made, again, asking for any input on the home you took the time on a Sunday to peruse, and....nothing!&nbsp; It is the most frustrating of moments to have nothing to tell this desperate homeowner who felt like the world would change for them in 10 minutes on this Sunday!</p>
<p>Feedback is, to so many I speak to in the industry, an obnoxious waste of time.&nbsp; So many say, if their clients had any interest in the home they would have made contact!!!</p>
<p><strong>REALLY???</strong></p>
<p>To me, feedback is a way, as REALTORS, to support each other in every market - good or bad!&nbsp; Sometimes it is a way to get constructive criticism to our clients in a non offensive way!&nbsp; A way to once again say "We need to lower the price", a way to finally get rid of that neon pink room - and other times to pat our client on the back and say, "Your house was wonderful, just not what they are looking for".&nbsp; Feedback is not only our link to our clients, but also our link to each other!&nbsp;</p>
<p>&nbsp; So, we don't work for the same Team or the same company... so why should you help me?&nbsp; You can go it all alone in this world, But I can promise you it is a lot less productive and a lot less interesting!!!&nbsp; I am here to tell you all, big and small, United We Stand, Divided We Fall:)&nbsp;&nbsp;&nbsp;</p>

<div class="pips"><img class="pips_img" title="Re-blogged 0 times" onclick="$('reblog_info_1475322').show()" src="http://activeagent-prod-assets3.ar-img.com/images/new_design/pips_0.gif?1265262346" alt="Re-blogged 0 times" />So my buyers had their third builders meeting last week to pick out floors, paint colors, appliances and etc...&nbsp; The wife had to come into town on her own as her husband could not get away from work.&nbsp;&nbsp; She e-mailed me a few days before to ask if I would come with her again so she did not have to be alone...&nbsp; I said of course I will be there - it is my job to be there!!!!&nbsp;</div>

<p>While in our meeting at the model home, the on duty agent came in to say hello and said to my client that she was lucky she had such a nice agent to show up through-out the process.&nbsp; She said after watching hundreds of homes go up, I was only the 2nd agent to come to all the meetings with my client!&nbsp; I was amazed!!!</p>
<p>When I thought of all the single sheets of upgrade contracts my clients had signed over the last few months (that I personally looked over first AND I might mention found several flaws and messed up numbers)&nbsp; I was just totally amazed that more Realtors do not guide their clients through the building process.</p>
<p>When I posted this question to some other collegues - their excuses floored me!!!&nbsp; I got excuses such as "I do not have time for that"! and "Picking out floors can be a personal experience and they don't want their Realtor there"!&nbsp;&nbsp; I don't know about you guys, but buying a home in general is, next to marriage and having children, one of the most personal and biggest decisions someone makes in life.&nbsp; So why would we leave them to go it alone because they are building - especially when there are months more of contracts involved???</p>
<p>With many builders making a commission available to the Realtors after receiving a down payment and contract - I fear this situation is getting worse.&nbsp;&nbsp; We should not be disapearing from our clients process when they may need us the most....&nbsp;</p>

</div>]]></description><link>http://www.edhomeseller.com/Blog/Your-buyers-are-buildingWhere-did-you-go</link><guid>http://www.edhomeseller.com/Blog/Your-buyers-are-buildingWhere-did-you-go</guid><pubDate>Sat, 06 Feb 2010 03:00:00 GMT</pubDate></item><item><title>Procrastination Kills...Literally!</title><description><![CDATA[<p>Now that I have a blog, that means I have to actually write a blog.&nbsp; To me this reminds me of some homework assignment given to me while junior high school.&nbsp; You know the one I am talking about, free write for 20 minutes about anything.&nbsp; So you start out with something like, &ldquo;I can&rsquo;t believe I have to free write something for 20 minutes, what am I going to write about?&nbsp; Well there&rsquo;s that cute new girl named Laura, she said Hi to me and smiled.&nbsp; That was kind of cool.&nbsp; Then she got bombarded by the Jock Squad and I was soon forgotten.&rdquo;&nbsp; At least that was how my free writing experience typically went.&nbsp; Writing a real estate blog feels eerily similar.&nbsp; I sit behind my keyboard prepared to write and then see that my desk is a wreck and I think I should clean it off first and then I&rsquo;ll write the blog.&nbsp; Meanwhile I pray someone will call me and interrupt me so I may perhaps put the blog off for one more day.&nbsp; But if there is one thing I&rsquo;ve learned is that procrastination is not only silly, it can be devastating.</p>
<p>&nbsp;</p>
<p>In December I learned that a dear friend of mine who had been fighting cancer was at the end of the line.&nbsp; He was admitted to Hospice Care in Durham.&nbsp; His wife contacted me to inform that he was nearing the end. &nbsp;I planned to go and visit him on Saturday, but life interrupted and I did not make the trip. I rescheduled it for the following Wednesday.&nbsp; I called the night before to tell the wife I would be up the following morning only to find out that Ken had passed just a few hours prior to my call.&nbsp; I was devastated.&nbsp; I was devastated at the loss of one of the most pure souls I&rsquo;ve ever known.&nbsp; I was selfishly devastated by the fact that I did not get to say goodbye.&nbsp; I made a promise that I would not procrastinate on matters of such importance ever again.&nbsp;</p>
<p>&nbsp;</p>
<p>Obviously a blog isn&rsquo;t life or death,&nbsp; but as the old saying goes, &ldquo;Never put of til tomorrow what you can do today, because tomorrow your friend might be dead.&rdquo;&nbsp; That is not the old adage, but that&rsquo;s if for me.&nbsp; Morbid, yes.&nbsp; Depressing, certainly.&nbsp; But Ken would laugh at that quote, as would his wife.&nbsp; Incidentally, after the tears and heartbreak during that phone call with his lovely wife I said, &ldquo;Well I was calling to say I&rsquo;ll see you in the morning&hellip;but I guess not&rdquo;.&nbsp; We laughed&hellip;because we could not cry anymore.&nbsp; Live, love, and laugh DAMMIT!</p>

I&rsquo;ll be honest, I can&rsquo;t even believe I&rsquo;m blogging but it seems to be the thing to do these days so what the heck.</span></span></p>
<p><span style="font-size: 12pt;"><span style="font-family: 'Times New Roman', serif;">&nbsp;</span></span><span style="font-size: 12pt;"><span style="font-family: 'Times New Roman', serif;">Thank goodness for 2010. Out with the old and in with the new right? But in the big picture 2009 real estate in New Hanover County wasn&rsquo;t all that bad, certainly not as bad as the general perception of the market. In fact, the median price for 2009 residential homes sold in New Hanover County was only down a mere 3% from 2008. However, the number of properties sold per month in 2009 was up 1%. So all in all I think we are fairing pretty well.</span></span></p>
<p>&nbsp;</p>
<p><span style="font-size: 12pt;"><span style="font-family: 'Times New Roman', serif;">And it looks like 2010 is starting off with a bang. There are some great homes for sale in Wilmington, NC and its surrounding areas and the public is taking notice! I&rsquo;m pleased to report that I have, as recently as 1/21/2010, put two (2) investment properties under contract. One is a triplex and the other is a townhouse. This is a great sign that perhaps the investors are regaining some confidence in the local market and starting to pick up some the great values that are to be had in the epic buyer&rsquo;s market.</span></span></p>
<p>&nbsp;</p>
<p><span style="font-size: 12pt;"><span style="font-family: 'Times New Roman', serif;">Another positive sign is the government has extended the $8000 first time buyer tax credit to April 30, 2010. They even added a provision that expands the tax credit to &ldquo;move up&rdquo; buyers. These buyers are eligible to receive a $6500 tax credit if they are under contract by April 30, 2010 and close by June 30, 2010.</span></span></p>
<p>&nbsp;</p>
<p><span style="font-size: 12pt;"><span style="font-family: 'Times New Roman', serif;">Interest rates are still at record low rates. 4.75% can still be had, so if you are on the fence about buying your new home, GET OFF! All indications are rates will start to climb as the housing recovery continues to gain momentum.</span></span></p>
